(D) INEQUITABLE TO REVERT It must b e inequitable for the promisor to go back on his promise and revert to his strict legal rights. (E) A SHIELD OR A SWORD In Coombe v Coombe it was held that this doctrine cannot be raised as a cause of action (sword) but only as a defence to a claim (shield). (F) EXTINCTIVE OR SUSPENSIVE OF RIGHTS If D relies on this doctrine the courts will also look at the nature of Zà ¢Ã¢â€š ¬Ã¢â€ž ¢s promise and whether it was his intention for there to be a suspension or extinction of his legal rights. In the case of High Trees it was held that the promise was intended to be temporary in nature and the promisor had the right to reassert his full legal rights. Tool Metal Case (1955) also supported this position. However in the case of D C Builders, Lord Denning held that the full effect of the promise was to extinguish the legal rights of the promisor. In looking at the words used by Z in making his promise, it appears that his intention was to resume his legal rights to sell the bike to whomever he chose after Saturday. CONCLUSION It is unlikely t hat B and C have a cause of action against Z because there is no contract in existence between or an intention to create legal relations. In fact there is not even the formation of a valid offer and acceptance. In the case of D however many components of a contract had been made, with an offer, acceptance and intention to create legal relations although because the bike had not been exchanged for  £ 200 the contract was not concluded. However the doctrine of promissory estoppel arises in such circumstances where there have been negotiations and promises made and the court is of the view that it would be inequitable for the promisor to renege. D is therefore likely to succeed if he brought an action under this doctrine and his remedy will be awarded according to what is just and equitable for instance if due to Zà ¢Ã¢â€š ¬Ã¢â€ž ¢s promise he had the opportunity to purchase a les expensive bike, the difference could be awarded to him. In order to illustrate why this policy is potentially harmful to the militarys warfighting capabilities, an honest discussion of the physical differences between the sexes is called for. A yearlong study conducted by the United States Marine Corps (USMC) yielded confirmation of long-recognized differences between the sexes in areas that directly affect combat task performance. The study contrasted mixed-gender squads against all-male squads. One of the significant discoveries was that the mixed-gender squads were less lethal than their counterparts. This was due to mixed-gender squads performing worse with various weapons-systems typical to an infantry team (M4, M249, M203). These squads not only scored lower in basic marksmanship; they moved slower and generally performed worse in combat drills that featured tactical movement with the afore-mentioned weapons (Peralta, 2015). The females generally had a more difficult time moving with the weapons and associated gear required for the combat infantry mission. A potential explanation for these difficulties lies in the physical differences between the sexes. According to the Marine Corps study; females have a higher percentage of body fat: 24% for females and 20% for males. On average, females possess 15% less anaerobic capacity, and 10% less aerobic capacity than males. This means that the top 10% of female overlapped with the bottom 50% of males. Even more concerning than that, however, is that female Marines were 6 times more likely to be injured in training than their male counterparts (Peralta, 2015). The discrepancies in average performances and injury rates is partially explained by more physiological facts. The average female Marine was more than 4 inches shorter, had 37 fewer pounds of muscle, and had nearly 6 pounds more fat than a male. They also were measured to have only 55% of the upper body strength and 70% of the lower body strength of a male Marine (Peralta, 2015). These differences have been recognized and codified in the differing physical testing standards the military uses to evaluate their servicemembers. Every branch of the U.S. Armed Forces has lower standards for passing on their respective physical fitness test for females (Fumento, 2016). The military is supposed to be a meritocracy. Because of the unique nature of its mission, the military has the legal ability to discriminate based on physical condition and fitness in ways that civilian or other governmental agencies are not able. This is because the ability to successfully prosecute a war requires the best, most fit, most disciplined Soldiers, Sailors, Airmen, and Marines available. In order to fit females into roles formerly closed to them, the DoD must simultaneously enact policies that ignore important differences between males and females (open combat-arms to females) and keep in place physical testing standards that acknowledge those differences vis-? -vis lower standards for females (Simons, 2018). This schizophrenic policy and the cognitive dissonance that seems to have resulted from it breeds confusion, mistrust, and resentment. These feelings are not conducive to building and maintaining effective warfighting units (Klimas, 2016). The usual arguments cited against integrating combat-arms units can be made again: there will be romantic entanglements and competition for the affection and attention of the females. These entanglements will lead to pregnancies. We know these things occur on a regular basis because we see them happening in non-combat-arms units that are currently gender-integrated. The means by which the DoD attempts to mitigate these problems creates further complications. Separate sleeping quarters, for example, presents serious logistical challenges; and can be very expensive. The Navys current program to refurbish its submarines is a contemporary example. Separate quarters also prevents the sort of bonding that occurs between servicemembers of the same gender (Klimas, 2016). In the midst of the debate over whether or not the new policy is tenable and practical, few people are talking about what seems to be a lack of enthusiasm for this experiment on the part of women themselves: they are not signing up. The vehemence with which advocates for the change demand it would suggest that there would have been a rush to fill these slots by females. The opposite seems to be the case (Scoti, 2016). The Sergeant Major of the Army (the highest-ranking enlisted member of the Army and advisor to the Secretary of the Army) recently put out a call for female Soldiers to step up and sign up for combat-arms jobs (Tan, 2016). If this radical policy is expensive, causes morale and esprit-de-corps problems, decreases the effectiveness of combat-arms units, and is not being embraced by those it was meant to benefit; then should it be in place (Donnelly, 2016). The military should not be the place for social experimentation. While it is often referred to as a microcosm of society; to a great degree, the military is a bastion against societal change. Human Trafficking Essay Human trafficking is where a person is exploited by being recruited, transported, transferred and harbored through the use of force. Human trafficking affects every country in the world whether trafficking is conducted in the country of origin, transit or destination for the victims. Thousands of people are trafficked every year in their native countries or abroad. Human Trafficking has been described by some as modern day slavery. It is now one of the fastest growing transnational organized crime. The U. N. eports that there is an estimated one million people trafficked all over the world each year. Trafficking in persons has been described as modern day form of slavery. It is a serious human rights violation and is reported by the United Nations to be the fastest growing form of transnational organized crime. Human Trafficking Issues The major issue advocates against human trafficking face is how to educate and help prevent people from falling victim to human trafficking. Many are tricked into trafficking through job offers abroad. Identifying victims of human trafficking can be difficult. Many trafficked victims may have been forced into prostitution or they may have been caught crossing borders illegally, and because of these reasons they are not very free to approach the police. Language barrier might play a role in a victim not being able to seek help and most times traffickers threaten the victims that their families will be harmed if they were to come forward. It is also hard for advocates against trafficking to convince traffickers to leave the occupation because according to U.  N. estimates, trafficking is the third largest illegal industry which generates close to $ 7 billion to $ 10 billion a year. Surprisingly, an estimated 200,000 American children are trafficked into the sex industry each year and 17,500 foreigners are trafficked into the US. The victims of trafficking mostly come from distressed living conditions such as poverty or abuse and therefore are more vulnerable to deception from traffickers. Eighty percent of the trafficked people are women and children. It is almost impossible to keep track of the statistics of people who are trafficked each year because it is an underground industry. Trafficking is the third largest illegal industry worldwide and does not require much experience and skills and the returns are great, therefore it attracts men and women alike. Traffickers may operate on their own, with their families or some are in more organized groups. Since it does not require a lot of skills, governments with young unemployed youth might find their youth getting involved in the field. Another issue is that once these victims are trafficked and are not able to escape, they fall victim to the â€Å"human trafficking disease† and become traffickers themselves, thereby making it hard to have victims come forward and speak against the trade. Corruption plays a great part in allowing this trade to continue. It is important to note that laws against trafficking vary from country to country, so it is important for one to verse themselves on the laws of each country. However, universally all countries are against trafficking in the books, but the difference might come when it comes to enforcement of the laws. Police corruption in some countries plays a big part in lack of enforcement of the laws. Some police may get payment from the traffickers to look the other way. Victims are encouraged to seek help from organizations that deal with helping individuals free themselves from human trafficking. The best place for trafficking victims to seek refuge is through non-governmental organizations (NGO). NGO’s offer victims a safe place to recover with support from fellow survivors and advocates. Services offered at NGO’s may vary but most will offer temporary shelter, clothing, food, healthcare, counseling and career exploration. The Issue sometimes becomes that the victims will not want to seek help from such places because of fear and shame. Some victims may have contracted sexually transmitted diseases and may have been mentally and physically abused to the point that they feel that they are not worthy and whatever the traffickers tell them about themselves is what they believe. The complex root problems and the limited degree of awareness are factors that make it difficult to fight human trafficking. War, natural disasters, poor social and economic conditions and lack of assistance for victims have helped exacerbate the problem. The trafficking social, psychological and healthcare costs are high to governments. However, these costs are small compared to the long term effects trafficking may do to a nation. The constant irregular migration decreases the human capital and affects the social fabric of the nations affected. Although the human trafficking issue seems like a problem too big to handle, advocates however have not given up. Many inter-governmental bodies, donors, and NGO’s have started addressing the issues from different angles. Some organizations want to start tackling the issue from the source by helping with prevention, re-integration and awareness at the local level. U. N. offers help to nations by helping them draft laws and create national anti-trafficking laws. However, translating the written laws into practice is where the problem lies. Very few individuals have been arrested for human trafficking crimes. The only way governments will be able to help reduce the human trafficking problem is mostly through aggressive awareness programs, whereby curriculums are set in schools with such awareness in mind. Stiffer penalties for traffickers should be implemented, better corporations among governments in releasing information about criminals, a support system whereby people are able to go to seek help, governments should work together to have technology that can dictate fake documents such as passports and border enforcement should be funded and made more stricter. Since most of trafficking occurs during periods people are desperate, it is important that whenever a war breaks out, or there is a natural disaster, governments and NGO’s should take more precaution in verifying the final destination of refugees, and probably do a follow up to ensure that those refugees are safe wherever they stated they were headed. Human trafficking just liked drug trafficking needs humans to move the goods, so the only way to help alleviate the problem is for governments to improve the living conditions of its citizens and offer its citizens satisfactory employment that will keep them away from human trafficking.
